Terms of Use
This English text is a reference translation. Where it differs from the Japanese original, the Japanese version prevails.
These Terms of Use (the “Terms”) set out the conditions for using “O®b. (Orb)” (https://orb.higashiyuki.com/; the “Service”), provided by Yuki Higashi (東 裕樹; the “Operator”). By using the Service, users are deemed to have agreed to these Terms.
Article 1 (The Service)
The Service is a web application that draws figures from mathematical formulas and exports them as images and videos. It can be used free of charge, and the paid plans (subscription and single purchase) offer exports without the logo, among other features.
Article 2 (Paid plans)
- The subscription (¥1,078 per month or ¥8,580 per year, tax included) allows exports in all formats without the logo (including Copy SVG and 4K). One license key can be registered and used on up to 2 devices. Only one device of each type (computer, smartphone or tablet) can be used at a time.
- A single purchase (¥385 for an image or ¥605 for a video, tax included) allows the work, as it was at the time of purchase, to be exported without the logo: images via Save SVG, Save PNG and Save JPG; videos via Save MP4 and PNG sequence (excluding 4K). The export period is 30 days from purchase.
- During the export period, even if the Service has been changed, the user may reopen the work and export it using the version of the Service that was current at the time of purchase.
- A single purchase covers the settings of the work at the time of purchase. After purchase, the only settings that can be changed while still allowing export are light / dark, the export format and the background (and, for videos, the video size within the same aspect ratio).
- The prices and details are as shown on the purchase screen and in the Legal Notice under the Act on Specified Commercial Transactions.
Article 3 (Payment)
Payments are received and processed by Sold through Link, LLC, a Stripe group company, as the seller (merchant of record). Link’s terms of use (https://link.com/terms) also apply to payments. Credit card details are sent directly from the checkout page to Stripe, Inc. and its affiliates, which manage them. They never pass through the servers of this site (O®b.), and the Operator does not store or manage card details.
Article 4 (Automatic renewal and cancellation)
- Until canceled, the subscription renews automatically every month (or every year for the annual plan) on the date corresponding to the original subscription date, and the fee is charged at each renewal.
- The subscription may be canceled at any time via Link (app.link.com). After cancellation, it may be used until the end of the paid period. No prorated refunds are provided.
- If a renewal payment fails, paid-plan features will become unavailable after a 7-day grace period.
Article 5 (Returns and refunds)
Due to the nature of digital goods, requests for cancellation, return or refund are not accepted after payment. However, the Operator will issue a refund in the event of a duplicate charge, or if a purchase cannot be exported due to a defect on the Operator’s side. Refunds may also be issued at the discretion of Link’s buyer support. A refunded purchase or license can no longer be used from the time of the refund.
Article 6 (License keys and links to open a work again)
The purchaser is responsible for safeguarding their license keys and the links to open single-purchase works again. These may not be transferred to or shared with others. The Operator is not liable for any damage resulting from their use by a third party who has obtained them.
Article 7 (Use of exported files)
- Files exported on a paid plan (subscription or single purchase) may be used indefinitely, for both personal and commercial purposes. This right continues after the subscription ends and after the export period of a single purchase ends.
- Files exported for free (with the logo) may be used only for personal, non-commercial purposes. They may not be used with the logo removed, or with the file altered so that the logo is not visible.
Article 8 (Prohibited acts)
- Removing the logo or circumventing purchase verification, such as by modifying the Service’s program
- Transferring, sharing or selling license keys or links to open a work again
- Unauthorized access to the server, or putting an excessive load on it
- Acts that violate laws or regulations, or that are contrary to public order and morals
Article 9 (Modification, suspension and termination of the Service)
The Operator may change the content of the Service or temporarily suspend its provision. If the Operator terminates the Service, the following shall apply:
- The Operator will give notice on the Service at least 30 days before the termination date, and will stop accepting new purchases from the date of that notice. Single purchases made before the notice may be used until the end of their export period.
- Subscriptions end on the termination date, and the Operator will refund, on a daily prorated basis, the amount paid for the portion of the paid period after the termination date.
Article 10 (Disclaimer)
The Operator does not guarantee that the Service will suit any particular purpose of the user or will always operate without defects. Except in cases of willful misconduct or gross negligence on the part of the Operator, the Operator’s liability in connection with the Service is limited to the amount most recently paid by the user for the relevant paid plan.
Article 11 (Changes to the Terms)
The Operator may change these Terms when the change is in the general interest of users, or when it does not conflict with the purpose of the contract and is reasonable in light of the necessity of the change, the appropriateness of the changed content and other circumstances. When changing these Terms, the Operator will announce the revised content and its effective date on this page and on the Service before that date. Changes that are disadvantageous to users will be announced at least 14 days before they take effect.
Article 12 (Governing law and jurisdiction)
These Terms are governed by the laws of Japan. The district court having jurisdiction over the place of the Operator’s domicile shall have exclusive agreed jurisdiction as the court of first instance for any dispute relating to the Service.
